The US government has framed stringent laws for issuing firearms to civilians. It is obligatory for every individual to undergo the firearm background check process before getting the arms. Purchase of guns is denied to convicted felons, fugitives, minors, mentally instable, court marshaled from the defense forces, expatriates, etc.
In the earlier days, the gun sales used to take place on an 'honor system', where prospective firearms buyer just had to show an attested copy that stated they were not legally prohibited from buying guns. The dealers did not verify or conduct firearm background check on the buyer's credentials. Even criminals go the liberty to fake information and acquire guns for their illegal activities.
Brady Law
Introduced in 1994, this law changed the entire scenario as it became mandatory for firearms dealer to conduct firearm background check on prospective buyers before concluding a sale. This law was extremely effective and within six years of its implementation, it prevented over 600,000 felons, minors and people having violent history from acquiring firearms.
The law stated that processing of applications for purchase of guns would take a minimum five-day period. The authorities would then conduct firearm background check to verify whether the candidate is eligible to purchase firearms as per the legal requirements set by the laws.
National Instant Check System
It is a federal database, which contains criminal records and helps the authorities to carry out rapid firearm background check. Applicants can now get firearm within minutes rather than waiting for five days.
The downside of this system is that it did not give room for conducting thorough and detailed investigation of the candidate. Safety was being traded for convenience thereby risking the lives of others. Some of the details that would not find mention in firearm background check include records on mental health, conviction charges or complaints that which are not computerized.
